Definitions Canbucha.nl

Customer: the individual or entity with whom Canbucha.nl has entered into an agreement.

Parties: Canbucha.nl and the customer together.

Consumer: a customer who is an individual and acts as a private person.

Applicability of General Terms and Conditions

These terms and conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of Canbucha.nl.

The parties may only deviate from these terms and conditions if they have expressly agreed to do so in writing. The parties explicitly exclude the applicability of any additional and/or deviating general terms and conditions of the customer or third parties.

Prices

All prices used by Canbucha.nl are in euros, exclusive of VAT, and exclusive of any other costs such as administration costs, levies, and travel, shipping, or transport costs unless explicitly stated otherwise or agreed otherwise.

Canbucha.nl reserves the right to change all prices for its products or services, whether on its website or otherwise made known, at any time. Increases in the cost prices of products or parts thereof, which Canbucha.nl could not foresee at the time of making the offer or the conclusion of the agreement, may lead to price adjustments. The consumer has the right to dissolve an agreement as a result of a price increase as mentioned above, unless the increase is the result of a statutory regulation.

The price for a service is determined by Canbucha.nl based on the hours actually spent. The price is calculated according to the prevailing hourly rates of Canbucha.nl applicable during the period in which the work is performed unless a different hourly rate has been agreed upon. If the parties have agreed on a total amount for a service provided by Canbucha.nl, this amount is considered a target price unless the parties have explicitly agreed in writing on a fixed price that cannot be deviated from.

Canbucha.nl is entitled to deviate up to 10% from the target price. If the target price exceeds 10%, Canbucha.nl will inform the customer in a timely manner, justifying the higher price. In such cases, the customer has the right to cancel the part of the order that exceeds the target price increased by 10%. Canbucha.nl also reserves the right to adjust the prices annually and will communicate any price adjustments to the customer before implementation. The consumer has the right to cancel the agreement with Canbucha.nl if they do not agree with the price increase.

Payments and Payment Terms

The customer must make payments for the product in advance.

Payment terms are considered strict and require payment of the agreed amount no later than on the last day of the payment term. Failure to pay on time will result in the customer being in default without the need for Canbucha.nl to send a reminder or declare it in default.

Canbucha.nl reserves the right to make a delivery dependent on immediate payment or to demand security for the total amount of services or products.

Consequences of Not Paying on Time

If the customer does not pay within the agreed term, Canbucha.nl is entitled to charge an interest of 1% per month from the day the customer is in default, with part of a month counted as a whole month.

In case of default, the customer is also liable to pay extrajudicial collection costs and any compensation to Canbucha.nl, calculated based on the Decree on compensation for extrajudicial collection costs.

In case of non-payment on time, Canbucha.nl may suspend its obligations until the customer fulfills the payment obligation.

In the event of liquidation, bankruptcy, attachment, or suspension of payment on the part of the customer, Canbucha.nl's claims against the customer become immediately due and payable. If the customer refuses to cooperate with the implementation of the agreement by Canbucha.nl, they are still obliged to pay the agreed price to Canbucha.nl.

Right of Revocation

A consumer has the right to cancel an online purchase within a cooling-off period of 14 days without giving any reason, provided that:

  • The product has not been used.

  • It is not a product that can spoil quickly, such as food or flowers.

  • It is not a product specially tailored or modified for the consumer.

  • It is not a product that cannot be returned for hygienic reasons (e.g., underwear, swimwear).

  • The seal is still intact, in the case of data carriers with digital content (DVDs, CDs, etc.).

  • It is not a trip, transport ticket, catering assignment, or form of leisure activity.

  • It is not a loose magazine or newspaper.

  • It does not concern an (order for) urgent repair.

  • The consumer has not waived their right of withdrawal.

The cooling-off period of 14 days starts:

  • On the day after the consumer has received the last product or part of one order.

  • As soon as the consumer has received the first product with a subscription.

  • As soon as the consumer has purchased a service for the first time.

  • As soon as the consumer has confirmed that they will purchase digital content via the internet.

The consumer can exercise their right of withdrawal by notifying Canbucha.nl via info@canbucha.nl, using the withdrawal form downloadable from the Canbucha.nl website.

The consumer is obliged to return the product to Canbucha.nl within 14 days after notifying their right of withdrawal, failing which their right of withdrawal will lapse. The costs for returns are the responsibility of the customer, except when the entire order is returned. If the purchase costs and any other applicable costs qualify for reimbursement according to the law, Canbucha.nl will refund these costs to the consumer within 14 days after receiving the timely notice of withdrawal and the returned product.

Right of Suspension

Unless the customer is a consumer, they waive the right to suspend the fulfillment of any obligation arising from this agreement.
